Step-by-Step Instructions: Filing a UCC-1 in New York State
The official filing office for most UCC-1 Financing Statements in New York is the Department of State (DOS). E-Filing is the fastest and least expensive method.
Phase 1: Preparation (Before Filing)
Step 1: Secure the Official New York Form
New York State requires its own specific forms, which differ from the national standard UCC forms.
Action: Go to the New York State Department of State website's Uniform Commercial Code section. Locate the UCC Financing Statement (Form UCC1). You must use the official NY form (paper or electronic).
Step 2: Ensure Accuracy of Data
Accuracy is paramount; a minor error in the Debtor's name can invalidate the filing. You must transcribe the data from your draft template onto the official form carefully.
DEBTOR (Box 1): The Debtor must be the exact name of the legal entity.
SECURED PARTY (Box 3): This is your designation as the living principal.
COLLATERAL (Box 4): Enter the full, comprehensive description of the collateral. If the description is long, you must use the UCC Financing Statement Addendum (UCC1Ad) form and reference it in Box 4 of the main UCC-1 form.
Step 3: Determine Filing Fee
Electronic Filing (e-Filing): $20.00 (Recommended)
Paper/Mail Filing: $40.00
Phase 2: Submission Process
Option A: Online E-Filing (Fastest and Cheapest)
Access System: Navigate to the NY DOS UCC e-Filing system page.
Select Form: Choose the Electronic UCC Financing Statement option.
Data Entry: Carefully input all data from your preparation (Debtor, Secured Party, Collateral).
Payment: Pay the $20.00 fee using an accepted credit or debit card (Visa, MasterCard, or American Express).
Confirmation: The system will provide an e-Filing Acknowledgment screen with your filing number, date, and time. Print this screen for your records.
Option B: Filing by Mail
Complete Forms: Print and meticulously fill out the official UCC1 form (and UCC1Ad if needed). Do not use the National Standard forms.
Payment: Write a check or money order for $40.00 payable to the "Department of State." (Checks over $500 may need to be certified).
Mailing Address: Send the completed form and payment to:
Phase 3: Post-Filing
Step 4: Receive Acknowledgment
The NY DOS will send you a filing acknowledgment, which includes the UCC File Number and the date/time of filing. This official record is essential proof that your interest is secured and perfected. This is usually returned by first-class mail.
Step 5: Maintenance
Duration: The UCC-1 Financing Statement is effective for five years from the date of filing.
Continuation: To maintain your security interest beyond five years, you must file a UCC Financing Statement Amendment (UCC3) to request a continuation. This must be filed within the six months before the five-year expiration date.

You can file your UCC-1 in any one of the 50 States. Your Filing gives the world your "Official Notice".

FYI, If you're Secretary of State REJECTS your UCC-1 then you have no choice but to go to another State. California SOS is one of those! I heard PIMA COUNTY in ARIZONA has been GREAT ACCEPTING these filings and are very familiar with all related documents! I have few friends that have Successfully filed there! 😄

thank you & great instructions to copy & save to your computer!!! 🤩 The advice I have received is to file one in New York and also in your state….if your state is giving you a hard time, then go to Pima County, AZ or another friendlier state.

Yesss just completed one in NY for my husband and I UCC-1 & a Non-UCC 😏 FYI UCC-1 and affidavit go together to seal the deal a UCC-1 is not a lien, a lien is a claim, a claim is EXPRESSED in an affidavit, which is filed on the public record on the Secretary of State website/Office of your choice which we prefer New York because it’s international and the Capital state. If you wanna be extra you can get the lien number do a 5 sentence ad in the newspaper, declaring the lien number about (four weeks) Now you have document or proof of claim on public record which they did not contest against it has been signed , sealed and delivered.🔥😉

I published mine in the UT Business Journal. It was less expensive than the paper. They sent an Affidavit after they published it. (4 weeks $87.50)
